1. Publisher

Klair is a trade name of Nextstep Expert Consulting Limited, a company registered with the RAK International Corporate Centre (UAE) under number ICC20250869, with registered office at Office 416, Burlington Tower, Business Bay, Dubai, United Arab Emirates.

2. Purpose

These Terms of Service (ToS) define the rules for accessing and using the Klair platform, accessible via klair.work and the Klair API (hereinafter "the Platform").

Any use of the Platform implies full acceptance of these Terms of Service.


3. Service description

Klair is a platform that exposes an MCP (Model Context Protocol) engine allowing users to connect their own AI account (Claude, ChatGPT, Gemini, Cursor...) to their business data and tools.

Core principle — User Sovereignty: Klair does not host any AI model and does not hold any API key on behalf of the user. Klair charges for platform access — never for AI token consumption. Tokens are the user's responsibility via their own AI account.

4. Service access

4.1 Account creation

Access to the Platform requires creating an account. The user commits to providing accurate information and keeping it up to date.

Account creation, credential management, passwords, OAuth connections and external connectors are managed exclusively from the Klair web interface — never via an AI tool.

4.2 Account security

The user is solely responsible for the confidentiality of their login credentials. Any use of the account under their credentials is deemed to have been made by the user.

4.3 Free account

A free account is available for life with limited features (300 contacts maximum, 60 credits per 12-hour window, no connectors). Limits are specified on the Pricing page of klair.work.


5. Workers and Skills

5.1 Pre-installed workers

Certain workers (Axel, Gutenberg) are pre-installed and cannot be uninstalled. They constitute the core of the service.

5.2 Activating workers and skills

The user may activate additional workers and skills from the Platform. Each activation requires explicit confirmation (checkbox) with indication of price, duration and conditions.

5.3 User configuration

The personalised configuration of each worker (userConfig) belongs to the user. It is retained even if a worker is suspended or deactivated.

5.4 Skill creation (creator plan)

Users with a Creator or Expert Creator plan can publish business bricks on the Klair Store. The creation of new workers is reserved for Klair and certified partners. Publication conditions are detailed in the Sales Terms.


6. User responsibilities

The user commits to:

  • Using the Platform in compliance with applicable laws and these Terms of Service
  • Not attempting to circumvent the Platform's technical limits
  • Not using the Platform for illegal, fraudulent purposes or purposes that infringe third-party rights
  • Not automating access to the Platform outside of the provided mechanisms (MCP API)
  • Respecting the rights of individuals whose data is processed via the Platform

The user is solely responsible for the content they generate, store or transmit via the Platform, including outputs produced by AI tools they connect.


7. Klair's responsibilities

Klair commits to:

  • Maintaining Platform availability on a reasonable best-effort basis, without quantified availability guarantees
  • Hosting data in the European Union (DigitalOcean, Frankfurt region)
  • Never using user data to train AI models
  • Actively monitoring Platform availability and health, and communicating transparently in case of incidents
  • Notifying the user of any substantial service changes with 30 days' notice

7.1 Third-party infrastructure dependency

Klair relies on third-party infrastructure (DigitalOcean, Cloudflare, Stripe, Unipile...) whose availability is outside Klair's control. In case of a major incident affecting these infrastructures, Klair cannot guarantee service continuity. Klair commits to communicating as promptly as possible about the incident status and expected recovery timeline.

7.2 Business data security

Access to user business data (CRM contacts, history, files...) requires valid JWT authentication. Klair does not access data in clear text outside of an authenticated session. Connected AI tools (Claude, ChatGPT...) access data only within the scope of the token authorised by the user.

Klair cannot be held liable for:

  • Outputs generated by third-party AI models connected by the user
  • Service interruptions attributable to third-party infrastructure providers
  • The user's use of AI tools
  • Indirect damages, loss of profit or data

8. Intellectual property

All elements of the Platform (code, interface, trademarks, native workers, InstructionSets) are the exclusive property of Nextstep Expert Consulting Limited.

Content created by the user via the Platform (CRM contacts, notes, published skills...) remains their property. The user grants Klair a limited licence for hosting and processing necessary to provide the service.


9. Suspension and termination

9.1 By the user

The user may delete their account at any time from their Klair account. Deletion results in erasure of all data within 30 days, except for data subject to legal retention obligations (billing: 7 years, consents: 5 years).

9.2 By Klair

Klair reserves the right to suspend or terminate an account in case of violation of these Terms of Service, fraudulent use or non-payment, after formal notice that has remained unanswered for 15 days except in cases of emergency.


10. Changes to the Terms of Service

Klair reserves the right to modify these Terms of Service. Any substantial modification will be notified by email 30 days before taking effect. Continued use after this period constitutes acceptance.


11. Applicable law and jurisdiction

These Terms of Service are governed by the laws of the United Arab Emirates. In case of dispute, the parties shall endeavour to find an amicable solution. Failing that, the dispute shall be submitted to the competent courts of Dubai.

For consumer users residing in the European Union, the mandatory provisions of the law of their country of residence remain applicable.
